A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the judge noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
